Cincinnati, OH, April 19, 2019. Last night U.S. District Court Judge Michael R. Barrett granted an injunction in favor of Planned Parenthood and Women’s Med Center of Dayton in their latest legal challenge to protect Ohio woman accessing safe and legal abortions. The ruling will stop most provisions of Ohio’s SB 145 from going into effect. The court ruled that the law was likely unconstitutional because it created an undue burden on woman seeking abortions after 15 weeks gestational age. The case was tried to Judge Barrett over three days last week.
Judge Barrett’s decision follows other courts in the country that have struck down Texas’ and Alabama’s attempts to ban the same safe procedure. “Ohio politicians should stop telling health care providers how to treat their patients,” said Jennifer Branch. “Ohio’s extreme abortion bans are blatantly unconstitutional, yet our elected officials keep wasting tax payer dollars passing these laws,” said Jennifer Branch. “While we were trying this case last week Ohio passed the six-week abortion ban that will effectively ban all abortions in Ohio. Most women do not even know they are pregnant at six weeks. It is time Ohio politicians stop endangering woman’s health,” continued Jennifer Branch.
Planned Parenthood of Southwest Ohio and Women’s Med Center Dayton were represented by Jennifer Branch of Gerhardstein & Branch Co. LPA, attorneys from Wilmer Cutler Pickering Hale and Dorr, and attorneys from Planned Parenthood Federation of America.
