In October 2014, Mansfield correction officer Stewart Mitchell, yanked a disabled inmate, Michael Kacmarik, out of a chair and onto the ground. Then Mitchell dragged Kacmarik along a hallway by his belly-chains. Kacmarik, represented by Gerhardstein & Branch, sued Mitchell in federal court for violating the 8th Amendment’s ban on cruel and unusual punishment, and for violating the Americans with Disabilities Act and the Rehabilitation Act.  Mitchell then filed a motion to dismiss Kacmarik’s case.  On Thursday, August 18, 2016, Judge Christopher Boyko denied Mitchell’s motion allowing the case to proceed to discovery.  Officer Mitchell’s actions were captured on video and have been filed in the case.
